Tucson is sentenced By Chip Warren The Arizona Daily Star For the second time in nine months, Robert Louis Murray, former South Tucson city attorney, was placed on probation for crimes stemming from his drug and alcohol addiction five years ago. Judge Bernardo Velasco of Pima County Superior Court issued the five-year suspended sentence yesterday to Murray for two counts of theft over $1,000 to which he had pleaded guilty last month. 'Murray, 41, stole nearly $22,000 from three clients between March and June of 1984 after he had been forced to quit his job as South Tucson's' lawyer and go into private practice. Murray, who is now a law clerk, took the money and fled to avoid prosecution on charges of possessing cocaine and drug paraphernalia for which he had been arrested in December 1983. He was arrested in Los Angeles in February 1988, convicted in Tucson last June of the drug charges and placed on four years' probation.

Velasco could have sentenced Murray yesterday to 10 years in prison on each of the theft counts, but instead required him to pay a $1,370 fine and $21,780 restitution to the State Bar of Arizona, which had reimbursed the bilked clients. He cited as mitigating factors Murray's community involvement and support, as well as his having been drug- and alcohol-free for the past 14 months. A number of people wrote letters to Velasco on Murray's behalf, including state Sen. Jesus "Chuy" Higuera, South Tucson Mayor Victor Soltero, and County Supervisor Dan Eckstrom. "I can't make excuses for my behavior," Murray told the judge.

"My alcohol and drug addiction has led me to lose a lot of things, including the right to practice law, material possessions, my wife, and the respect. of colleagues, fainily and friends." Murray, who was South Tucson's lawyer from 1977 to 1983, said in a pre-sentence report that his addictions first grew serious after a 1980 court case ended with the city being ordered to pay $3.6 million to wounded Tucson policeman Roy Garcia. South Tucson "was threatened with bankruptcy, and I took the loss and resulting criticism very hard," he said. After fleeing to California, Murray said, his problems became so severe that he lived for a while on the streets and in parks, selling his blood to pay for food. Defense attorney doesn't show, gets contempt citation An assistant Pima County public defender was cited for contempt of court after she allegedly refused to participate in a client's trial this week.

Maddalena Fiorillo was cited Wednesday by Superior Court Judge Leslie Miller for not previously notifying the court that she would be unable to appear on behalf of Luis Ortiz because of conflicts in her schedule. Ortiz was slated for trial in absentia that day along with two co-defendants, all of whom faced drug charges after their arrests last November. However, Fiorillo said yesterday that the citation was "outrageous" because Miller had "totally ignored" a motion she submitted in January asking to withdraw from the case. Fiorillo's motion said she had two other, trials that also were to start on March 21, and could not prepare a defense for Ortiz because she had met him once briefly at the county jail before he posted bond and disappeared. "It (the contempt citation) is just discrimination against public defenders," Fiorillo complained.

"She (Miller) used to be a public defender; she knows what we're going through over here" in terms of having heavy caseloads. Miller declined to respond to the defense lawyer's argument, saying the issues would be addressed at a hearing set for 3:30 p.m. Monday. At. that time, Fiorillo could be fined up to $300 and sentenced to six months in jail.
